【禁聞】美國在華企業的擔憂

【新唐人2011年3月24日訊】有報告說,71%的美國在華企業認為,中國的企業經營許可程序對外資企業存在(歧視)。許多美國在華企業表示,中國的官僚主義和法律法規不明確,影響了他們的投資和招募計劃。他們對中共的政策越來越傾向中國本土企業的利益,表示擔憂。

3月22號,“中國美國商會”發表了2011年度《商務環境調查》報告,這份報告顯示,中國的企業經營許可程序實際上歧視了外資企業。他們同時對許可程序的透明度、所需時間、能否獲批以及有關法規能否正確實施表示擔心。

“中國美國商會”是北京政府承認的美國在華商界代表。它是一家獨立的非盈利性非政府機構,擁有2600名在華經商的美國企業及個人會員。商會每年都要對會員進行調查,針對一系列的中國商業環境相關問題,提出報告。

《美國之音》報導,中國美國商會主席狄安華(Ted Dean)在一個新聞發佈會上說,官僚主義已經成為美國企業在中國經營的最大挑戰。

狄安華批評說:“儘管中國加入世界貿易組織(WTO)已經十年,卻仍然沒有實現建設公平透明的監管環境的目標”。他呼籲:“更寬的市場准入、更高的透明度、更強的知識產權保護力度,和更公平的競爭環境。”

而美國國際投資與戰略公司中國研究主管唐納德•斯特讚姆(Donald Straszheim)認為,“中國這麼做的目的是培植本土企業”。

他向《美國之音》表示:“北京是希望中國經濟由中國本土公司主導,而不是由美國、歐洲和日本的公司主導。他們相應的會給中國企業一些激勵措施,包括減稅等。”

2006年北京政府推出限制外資併購的10號文,國務院在近期發佈的《關於建立外國投資者併購境內企業安全審查制度通知》規定,從3月14號開始,外資併購境內企業需通過所謂“安檢”程序 。同時,國家發改委官員也宣佈,相關細則將在3個月之後推出。

旅美中國經濟社會學者何清漣表示,外資抱怨中國的制度執行過程不透明,是有無數案例可以作為佐證的。她在博客文章《在華外資缺的不是規則,是透明度》中寫道:“這種不透明與其說是制度造成,還不如說是中國“人治下的法制”的必然結果。因為只有不透明才能讓中國官員渾水摸魚,而且在摸了魚之後還能逍遙法外。”

何清漣舉出幾名涉及外資的腐敗案例,如(朗訊門)的中國建設銀行行長張恩照,他曾擔任中紀委委員。而商務部條法司的郭京毅,更是開創了立法腐敗的先河。何清漣表示:“郭利用手中修改、解釋商務法律法規的權力,極為隱蔽的按照行賄者需求設計制度。”不過,何清漣說,美國在華企業向美國司法部檢舉的中國受賄高官,大多在中國沒有受到懲罰。

Survey shows that 71% of US enterprises in China

believe that they are discriminated against

in the licensing process. Companies complained

about the bureaucracy and inconsistent legal

treatment. Many expressed concerns about China』s

increasingly protectionist policies.

The annual 2011 Business Climate Survey conducted

by the American Chamber of Commerce in China

(AmCham-China) found China』s business licensing

procedures discriminated against foreign companies.

Many companies are concerned with the transparency,

length, and the equality of the licensing process.

AmCham-China is a Beijing-recognized non-profit

organization representing US companies in China.

AmCham-China conducts annual surveys among its

2600 members about the business climate in China.

According to AmCham-China Chairman Ted Dean,

bureaucracy has become the number one concern

among members of AmCham-China.

Ted Dean criticized China for lack of regulatory

transparency after a decade in the WTO. He calls

for “greater market access,increased transparency,

improved [intellectual property right] protection

and a fairer playing field”.

Donald Straszheim, Head of China research at

International Strategy & Investment Group, believes

China is trying to protect its domestic companies.

“I think Beijing would simply like to have China』s

economy dominated by Chinese companies,

not by companies from America, Europe, or Japan”,

said Donald Straszheim to VOA.

He believes China will provide domestic companies

with stimulant measures including tax reduction.

Beijing government has issued new regulations on

foreign acquisition, requiring all foreign

acquisitions of Chinese companies to go

through “security checks” starting March 14.

Detailed implementation plan of such regulations

will be announced next month.

According to China expert He Qinglian, there are

many examples of lack of regulatory transparency.

She wrote on her blog: “Such lack of transparency

is caused by the fact that laws can be bent

by officials. Because the lack of transparency

allows such officials to commit wrongdoings

and escape punishment.”

He Qinglian talks about foreign-related corruption

cases, including the Lucent bribery scandal and

the case of former Ministry of Commerce official,

Guo Jingyi, who “abused his power to manipulate

the law and designed policies to accommodate

bribers”, according to He Qinglian

He Qinglian also points out that most of these

corrupted Chinese officials exposed by US companies

are not penalized in China.
