【新唐人2011年6月10日訊】在今年大陸掀起公民參選人大代表的風潮之後,中共做出回應。全國人大法工委某負責人表態說,“獨立候選人沒有法律依據”。但有獨立參選人認為,“獨立候選人”這只是一個不規範的叫法,本身就是指『公民聯名推薦候選人』。也有人反應表示,當局在稱謂上大做文章沒有必要。
6月8號,大陸「新聞聯播」引述這位匿名發言人的話說,根據中國《憲法》和《選舉法》,中國的縣鄉人大代表候選人,只有“由各政黨、各人民團體和選民依法按程序提名推薦”的“代表候選人”,經討論、協商或經預選確定的“正式代表候選人”,沒有所謂的“獨立候選人”。“獨立候選人”沒有法律依據。
《法國國際廣播電臺》記者曹國星認為,這是中國官方(中共)對這次縣鄉基層人大選舉中,湧現的“獨立候選人”現象,發出的黃牌。
吳丹紅(中國政法大學副教授):「這個稱謂本身就應該叫『公民聯名推薦候選人』或者『公民聯名推薦參選人』。而且這個裡面也已經提到了,公民十個人以上可以聯名推薦。所以實際上意思上是一樣的。我們民間說這個獨立候選人,也就是我們說的公民十人以上聯名推薦的意思。這個意思在他裡面已經表述的很清楚了。只是說我們之前獨立候選人的提法是不規範的。」
去年曾經參選北京律師協會主席的北京律師楊慧文認為,官方在“獨立候選人”的稱謂上大做文章沒有必要。
楊慧文(北京律師):「因為選舉制度是為了促進民主,促進選舉制度科學化,不是說拿上一個東西刻板的,咬文嚼字的去做這些文章。如果這樣的話,那法制都沒有甚麼實質意義的。法制的精神在於他的精神。」
將參選成都市武侯區人大代表的作家李承鵬說,人大似乎不是說“獨立候選人”沒法律依據就不能參選,而是指說“獨立候選人”這提法沒法律依據。
宣佈將參選北京市昌平區人大代表的時評作者“五嶽散人”則表示,“其實叫甚麼都不重要,我們還是獨立於這個體系之外進行參選。”
針對公民參選的風潮,宣傳部發出禁令,要求媒體封殺獨立參選的報導,多名參選者受到國保約談。成都、北京等地的黨委宣傳部已發出禁令,禁止媒體報導李承鵬的參選活動。
這次人大官員的表態,是否意味著當局開始打壓公民參選的勢頭?
宣佈參選區人大代表的《姑蘇晚報》編輯吳林表示,目前他的競選活動還沒有遇到來自中共的任何阻力。他認為公民參選是一個好事情,有助於提高公民權利意識,當局沒有理由打壓。
吳林(《姑蘇晚報》編輯):「這個事情是憲法規定的事情,而且是在法律現象之內,當局為甚麼會感覺到威脅呢?當局應該感覺到欣慰,是民眾參與,而且民眾又不是對抗政府,只是行使憲法賦予的權利。」
自中國作家李承鵬5月25號通過微博,率先公開確認參選基層人民代表後,一股“公民自薦參選人大代表風”迅速刮起,截至5月29號,至少有近百人表明,依法獨立自薦參選所在地的基層人大代表。這些人當中,有「天涯社區商務運營」總監梁樹新、中國作家協會會員夏商、中國政法大學副教授吳丹紅等。
作家兼房地產商曹天宣佈要競選鄭州市市長。曹天承諾,參選成功後自己任期內不拿一分錢工資,並且城管絕不可能打百姓,官員腐敗一定嚴懲。

Independent Candidates “Illegal”
The Chinese Communist Party (CCP) responded
to the increase of individuals participating
in local elections. The authorities branded
』independent candidate』 as illegal. Participants
said 』independent candidate』 is just name, and isn』t
different to "candidate jointly recommended
by the voters." Many say authorities over-reacted
on the name of “independent candidate.”
On June 8, CCTV quoted an anonymous expert
by saying that according to the Constitution
and the Election Law, candidates for local elections
can only come after the recommendation
and discussion of different parties, people』s groups
and voters. 『Iindependent candidate』 does not exist
as it has no legal grounds, claims CCP』s mouthpiece.
Radio France Internationale reporter Cao Guoxing
said this was CCP』s official warning
to the mushrooming 『independent candidates.』
Wu Danghong (A/Professor at China University
of Political Science and Law): “The term should be
『candidate jointly recommended by citizens』,
as 10 or more citizens can recommend a candidate.
So, when it says grassroots』 『independent candidate』
it means a candidate recommended by 10+ people.
The meaning should be more than clear. It was just
that 『independent candidate』 might not sound
as professional, but there is nothing wrong with it.”
Beijing lawyer Yang Huiwen, who ran for Chair
of Beijing Bar Association last year, said that it was
unnecessary for CCP to find fault with the term.
Yang Huiwen: “The election system was created
to promote democracy and make the election process
better, not something stereotypical or quibbling.
It is meaningless to quibble a law in terms of its text.
The rule of law lies in its spirit.”
Li Chengpeng, an independent candidate in Wuhou
District of Chengdu city said, CCP did not seem
to discourage independent candidates to run,
only to point out that the term lacks legal grounds.
『Wuyuesanren』, who runs for Changping District,
Beijing said, “No matter what we are called,
we are independent of the regime
when we participate in the election.”

on Li Chengpeng』s election activities.
Is the official warning indicative of the onset
of CCP』s crackdown on independent candidates?
Wu Lin, an editor and independent candidate, said
his campaign did not encounter CCP resistance yet.
According to Wu, citizen participation in elections
is a good thing and helpful in raising awareness
of citizens』 rights. CCP has no reason to suppress it.
Wu Lin: “This is endowed by the Constitution.
It is within the legal boundary. Why did authorities
feel threatened? The CCP should be happy
because so many people participate in the election.
They were not against the CCP, but simply want
their rights, guaranteed by the Constitution.”
Since writer Li Chengpeng announced on May 25,
he would run in the election, a wave of individual
election participants surfaced. Since May 29, 100+
people announced they would run in the election.
They include Liang Shuxin, online company CEO,
Xia Shang, member of a writers』 association,
and Wu Danghong, an associate professor.
Cao Tian, writer and real estate agent, said he would
run for Zhengzhou mayor. He promised not to take
any salary once elected, to order city inspectors
not to harm people, and to punish corrupt officials.
